            <abstract xml:lang="en">
              <p>This article addresses the claim made by Martin Loughlin that Public Law is a foundational process. As a matter of fact, the history of administrative law, both in the UK and France, does not seems to follow this pattern. Rather, it is a non-foundational process, originating in case law and a process of “derogating” from private law. The article is based on a comparative exercise between two main jurisdictions: the UK and France. In both these countries, the rise of administrative law is briefly sketched in order to make good this claim that administrative law does not depend on a “foundation”, or at least some very particular one.</p>

            <abstract xml:lang="fr">
              <p>Cet article porte sur la thèse de Martin Loughlin selon laquelle le droit public est un procédé fondationnaire. De fait, l’histoire du droit administratif, britannique comme française, ne semble pas correspondre à ce schéma. Il s’agit bien plutôt d’un procédé non-fondationnaire, qui prend son origine dans la jurisprudence et un procédé « dérogatoire » relativement au droit privé. Cet article s’appuie sur l’examen comparatif de deux principaux systèmes législatifs : le Royaume-Uni et la France. L’émergence du droit administratif de ces deux pays est rapidement esquissée afin d’asseoir la thèse selon laquelle le droit administratif n’est pas subordonné à une « fondation » ou, si on concède que tel est le cas, il faut alors dire qu’il relève d’une fondation d’un type très particulier.</p>
