              <p>On November 8 2023, the Bureau of the National Assembly apparently put a definitive stop to attempts by opposition groups to pass a bill repealing the main provisions of the law on pensions of April 14, 2023. Since last spring, these efforts have seen the emergence of a dispute over the interpretation of the combined provisions of article 40 of the Constitution and article 89 of the National Assembly’s standing orders. Traditionally, control of the admissibility of bills creating a new burden on public finances, and therefore in principle inadmissible, was relaxed before the bureau of the Assembly, on the basis of a parliamentary convention interpreting the constitution. This convention was” eclipsed” during the preliminary parliamentary review of these repeal proposals. This blogpost attempts to retrace the conditions under which this “eclipse” occurred, with a view to better understanding the constitutional convention itself.</p>

              <p>Le 8 novembre dernier, le bureau de l’Assemblée nationale a semble-t-il fait obstacle définitivement aux tentatives des groupes d’opposition de faire voter un texte abrogeant les principales dispositions de la loi sur les retraites du 14 avril 2023. Depuis le printemps dernier, ces efforts ont vu émerger une querelle relative à l’interprétation des dispositions combinées de l’article 40 de la Constitution et de l’article 89 du règlement de l’Assemblée nationale. Traditionnellement, le contrôle de la recevabilité des propositions de loi créant une charge nouvelle, et donc en principe irrecevables, était assoupli devant le bureau de l’Assemblée, sur le fondement d’une convention parlementaire d’interprétation de la constitution. Cette convention a connu une éclipse lors de l’examen de ces propositions abrogatives. Ce billet tente de retracer les conditions dans lesquelles cette éclipse s’est produite, en vue de mieux comprendre la convention constitutionnelle elle-même.</p>
